Is that 173 in the background?
If it is you need to take it down and replace it with something else, 173 isn't covered by the CC license that all other scips are covered by.
Only way you can use an image of 173 is if you get permission by the original author.

I have no idea how you're arriving at that conclusion, but I can assure you that there are licensing issues. Please read through the licensing guide.

Started playing the game, it's a cool idea. I did encounter a glitch while playing. The game froze with the score at 34 and the speed at 22.
